Welcome to Bigshop Kenya Ltd ("Bigshop," "we," "us," or "our"). By using our website, www.bigshop.co.ke, and associated services, you agree to these Terms and Conditions ("Terms"). Please read them carefully before proceeding. If you do not agree to these Terms, you may not use our services.
1. Introduction
Bigshop is a multi-vendor e-commerce platform that connects customers to vendors. We operate as an intermediary by displaying vendor products on our platform. All payments and transactions are made directly between customers and vendors, with Bigshop adding a small markup on vendor prices for operational purposes.
2. Vendor Responsibilities
a. Product Listings
Vendors are responsible for ensuring that their product descriptions, prices, and availability on Bigshop are accurate and up-to-date.
b. Pricing
Bigshop does not alter vendor prices. Instead, we add a small cost to the product price, which constitutes our operational fee.
c. Customer Transactions
Vendors are required to:
Process payments directly from customers at their shop.
Issue receipts or invoices to customers at the time of payment.
Forward Bigshop’s portion of the transaction amount as per the agreement.
d. Compliance
Vendors must comply with all applicable laws, including consumer protection and tax regulations.
3. Customer Responsibilities
a. Accurate Information
Customers are responsible for providing accurate and complete information during checkout or any interaction on our platform.
b. Payment
All payments are made directly to the vendors’ shops. Bigshop does not handle direct customer payments for orders placed on the platform.
c. Invoices
Invoices generated on Bigshop serve as a record of the transaction and a security measure for both customers and Bigshop. Customers should retain their invoices for reference.
4. Bigshop’s Role
a. Platform Provider
Bigshop provides a platform to facilitate the connection between vendors and customers. We do not own, manage, or control the products listed on the website.
b. Fee Structure
Bigshop adds a small markup to the vendor’s listed product price. This markup is clearly reflected in the final price displayed on our platform.
c. Dispute Resolution
While Bigshop is not directly involved in transactions, we may mediate disputes between customers and vendors to ensure fairness and compliance with these Terms.
5. Payments and Revenue Sharing
a. Vendor Payments to Bigshop
Vendors are obligated to remit Bigshop’s portion of the transaction amount promptly after receiving payment from customers.
b. Invoicing Security
Invoices generated on Bigshop’s platform act as security for the vendor’s obligation to pay Bigshop its portion of the transaction.
c. Non-Compliance
Failure by vendors to remit Bigshop’s portion of the transaction may result in penalties, including removal from the platform.
6. Intellectual Property
All content on Bigshop’s website, including logos, trademarks, text, and graphics, is the property of Bigshop or its licensors. Unauthorized use is prohibited.
7. Limitation of Liability
Bigshop is not liable for:
Disputes arising from transactions between customers and vendors.
Product defects, delays, or any issues related to vendor services.
Any indirect, incidental, or consequential damages arising from the use of our platform.
8. Termination
Bigshop reserves the right to terminate or suspend access to the platform for users or vendors who violate these Terms or engage in fraudulent or harmful activities.
9. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with the "Effective Date" revised accordingly. Continued use of our platform constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of Kenya. Any disputes arising from these Terms will be subject to the jurisdiction of Kenyan courts.
